License

For purposes of these Terms, “Content” means any and all materials that are displayed, provided, distributed, downloaded, or otherwise made accessible through the Site, including without limitation text, writings, documents, images, videos, audio, graphics, icons, UI components, design elements, compilations, the selection and arrangement of data, downloadable files, software and updates, product descriptions and manuals, sample files, and any other information or works made available on the Site. “Original Work” means the original source materials, master files, productions, and all associated rights in the Content held by the Operator or the rightful owners. “Copy” means any digital reproduction that is displayed, transmitted, or otherwise provided to the User through the Site, whether stored temporarily or permanently, and includes, regardless of name, any cache generated in the course of browsing, any in-memory load for rendering, any downloaded file, any screenshot, any recording, any log output, or any other derivative or output that produces the same or substantially similar result.

All copyrights, ownership, title, and interests in and to the Content and the Original Work, and all intellectual property and proprietary rights therein, including without limitation trade secrets, know-how, compilation and arrangement rights, the right to create derivative works, distribution rights, public transmission/making-available rights, display and performance rights, and all other rights and benefits (including, to the extent recognized by law, moral rights such as integrity), vest exclusively in the Operator or the rightful owners. The User receives only the limited permissions expressly granted under this section and any related notices, and the Operator expressly reserves all rights not expressly granted. Under no circumstances shall any portion of the rights in or to the Content or the Original Work be assigned, transferred, disposed of, exhausted (including by any theory of exhaustion or first sale), or deemed to be granted by implication as a result of the User’s access to or use of the Site or the Content.

Even if the User views, executes, downloads, stores, copies, or otherwise uses the Content, the User does not acquire any copyright, ownership right, title, or other intellectual property right in or to the Content, any Copy, or the Original Work. What the User receives is solely a limited, conditional license, and not a sale or transfer of the Content. The provision, download, or storage of any Copy is independent of, and has no effect on, the ownership or rights in the Original Work, and shall not be construed as a transfer or disposition of copyright, the creation of any shared interest, any joint ownership, or any other change in rights. Likewise, even if any third party is able to access or view the Content or any Copy, such status constitutes only the ability to access that Copy and is unrelated to the copyright and ownership of the Original Work, and it does not give rise to any additional rights.

The Operator may grant the User a personal, non-exclusive, non-transferable, non-sublicensable, non-pledgeable, and revocable license, limited to: (i) performing temporary reproductions strictly to the extent technically unavoidable in the course of using the Site (including caching during communications, loading into memory for rendering, and other ordinary browser temporary storage), (ii) viewing the Content in the manner ordinarily provided by the Site, and (iii) only where the Operator expressly permits download of specific Content, downloading such Content and using it on the User’s own device for personal use. This license is valid only through the functions and paths expressly provided by the Operator (including official download buttons, official links, and official distribution files). Any acquisition through unannounced methods, circumvention paths, or abnormal technical means is not permitted. The User acknowledges and agrees that this license is conditional and may terminate immediately, without prior notice or procedure, upon any violation of these Terms or related notices.

Without the Operator’s prior written consent, the User shall not, in whole or in part, reproduce, distribute, transmit, publicly transmit (including making available), display, perform, rent, sell, resell, redistribute, share, mirror, frame, embed, publicly post, or otherwise publish the Content or any Copy; nor incorporate the Content or any Copy into any third-party service, database, repository, archive, or training dataset; nor use it to build a competing service, create a substitute site, or produce a substitute implementation. The User shall not excerpt, edit, rearrange, translate, summarize, modify, or otherwise transform the Content, nor create derivative works, in any manner that alters or distorts the original meaning, context, intent, or function, or that damages the Operator’s reputation, trust, or brand identification, or that causes misunderstanding or confusion. The User shall not use the Content or the Site in a manner that makes it appear as though the Operator endorses, recommends, guarantees, or sponsors any claim, product, service, viewpoint, or third party, nor in a manner that falsely implies affiliation with, approval by, or official status from the Operator.

The User shall not engage in scraping, data mining, automated collection, crawling, large-scale collection for model training or analysis, reverse-engineering observation, reverse engineering, decompilation, disassembly, extraction of source, structure, or metadata, analysis of network requests and responses, discovery of API endpoints, or any other act intended to reproduce, substitute, duplicate, or reimplement the Content or the delivery mechanism by which it is provided.

The User shall not remove, alter, conceal, or otherwise impair any watermark, copyright notice, trademark, logo, rights management information, notice text, license marking, integrity indicator, access-control mechanism, or any other identifier or protection mechanism included in or displayed with the Content or any Copy. The User shall not circumvent, disable, evade, neutralize, or facilitate the circumvention of any technical protection measures applied by the Operator, including access controls, license verification, download restrictions, encryption, signatures, integrity checks, or similar measures. Such measures are deemed essential to preserving the rights in the Content and the context in which it is provided.

Any portion of the Content that constitutes a software product or any component thereof may be further restricted or otherwise governed by a separate product-specific license, EULA, additional terms, or technical policies. Where such terms exist, the User shall comply with them, and nothing in this section shall be interpreted as reducing or relaxing those product-specific conditions. Any license key, activation information, or similar instrument is not evidence of ownership and is solely a control mechanism used by the Operator to permit access and use within the scope determined by the Operator.

If the User violates these Terms or any related notice, this Content license may terminate immediately regardless of any separate procedure or notice, and the Operator may restrict or block access to the Site and the Content. Upon termination, the User shall immediately cease all use of the Content and, except for technical remnants beyond the Operator’s control, delete and dispose of all Copies residing on the User’s devices or storage media to the extent reasonably possible. The Operator’s and rightful owners’ ownership and intellectual property rights shall remain in full force and effect after termination, and any post-termination use, retention, redistribution, or circumvention-based use may be treated as unauthorized use and infringement.

Any unauthorized use of the Content or any violation of this section shall be deemed an infringement of, or an act that realizes a risk of infringing, the rights of the Operator and the rightful owners. To the maximum extent permitted by applicable law, the Operator may pursue all available legal and equitable remedies, including immediate injunctive relief, removal of interference, and other interim or preservative measures. If the User’s violation causes damage to the Operator, or if the risk of damage is realized, the User shall be liable for all such damages. Where damages are difficult to quantify due to the nature of the violation, the Operator may, to the extent permitted by applicable law, seek damages based on reasonable criteria, restitution of unjust enrichment, and reimbursement of costs (including reasonable attorneys’ fees and expert fees). The Operator’s failure or delay in enforcing any right, or any forbearance shown in relation to a particular violation, shall not be construed as a waiver, and the Operator may fully enforce its rights at any time with respect to the same or similar violations.
